Terms and Conditions of the Digital Trinity online store

§1. General provisions and definitions

  1. These Terms and Conditions define the rules for concluding distance contracts via the online store available at www.digitaltrinity.pl (the “Store”) and the rules for providing services by electronic means.
  2. The Seller and administrator of the Store is Arkadiusz Trąbski, VAT ID (NIP): 8512986273, place of business: ul. Juliana Ursyna Niemcewicza 24H/1, 71-520 Szczecin, Poland, e-mail: info@digitaltrinity.pl (the “Seller”).
  3. The Customer may be a natural person (a consumer within the meaning of Art. 22¹ of the Polish Civil Code), a natural person conducting business activity (for orders directly related to such business), or a legal person or organisational entity (B2B).
  4. The Service Provider within the meaning of services provided by electronic means is the Seller.
  5. The Store sells digital and offset printing services and printed products (including business cards, leaflets, books, stickers, calendars, vouchers) produced to the Customer’s individual order, based on print-ready files supplied by the Customer.
  6. The contract is concluded in Polish (or in German/English for orders placed in the respective language version of the Store).

§2. Prices

  1. All prices in the Store are given in Polish zloty (PLN) and include VAT.
  2. VAT rates: 23% — standard printed products; 5% — books and publications subject to the reduced rate (Art. 41(2) of the Polish VAT Act).
  3. In the EN/DE versions the Store may display an indicative euro price (marked “≈”, calculated from the NBP rate with a margin) — the PLN price is always binding and the transaction is settled in PLN.
  4. Delivery costs, if applicable, are displayed before the order is confirmed and added to the price.
  5. Prices in the Store do not constitute an offer within the meaning of the Civil Code; they constitute an invitation to conclude a contract. The contract is concluded as per §3(4).

§3. Placing orders and conclusion of the contract

  1. Orders are accepted by the Store 24/7. An active e-mail address is required.
  2. To place an order the Customer must: configure the product (calculator), complete the order and delivery details and accept these Terms and Conditions (with reservation of Art. 8(1)(8) of the Polish Consumer Rights Act).
  3. After placing the order the Customer receives an automatic order acknowledgment at the provided e-mail address.
  4. The sales contract / printing service contract is concluded when the Store confirms acceptance of the order (confirmation e-mail).
  5. The Seller reserves the right to refuse to fulfil an order or its part if: products/materials are unavailable, the Customer’s data is doubtful, the order cannot be performed, or there is an obvious pricing error (e.g. a display error) — notifying the Customer without undue delay by e-mail.
  6. The Seller may contact the Customer to confirm the order data; lack of contact may result in cancellation of the order.

§4. Print files

  1. Production begins upon delivery of print files consistent with the technical specification on the product page (formats: PDF, JPG, TIFF; bleed, resolution, colour reproduction).
  2. Files may be uploaded via the upload form provided in the order confirmation e-mail (link valid for 7 days, max 10 files, up to 50 MB each) or sent to info@digitaltrinity.pl (quoting the order number).
  3. Uploaded files are automatically scanned for malware and stored outside the server’s public directory.
  4. Files are kept for 3 months from completion of the order and then automatically deleted.
  5. The Seller verifies the files only technically (format, resolution, bleed, colour profile). The verification does not cover the substantive content, spelling errors or the quality of the source files — the Customer is responsible for the content and correctness of the files.
  6. If files do not meet the specification the Seller will inform the Customer by e-mail; the production deadline is extended by the time needed to supply correct files.

§5. Payments

  1. Available payment methods:
    • online payments handled by Autopay S.A. — BLIK, payment card, electronic transfer,
    • bank transfer (prepayment) to the Seller’s account: 39 1140 2004 0000 3702 7835 4107 (mBank S.A.; reference: order number),
    • cash on delivery (payment on receipt, according to the delivery rates).
  2. Online payment settlement is performed by Autopay S.A.; the Store does not collect or store customers’ payment card data.
  3. Production starts after the payment is credited and the print files are accepted; for cash on delivery — after order confirmation.

§6. Performance and delivery

  1. The standard production time is 4–7 business days (express: 2–5 business days, if available for the product) from payment crediting and acceptance of print files, depending on the product and quantity.
  2. Delivery in Poland is made via: InPost parcel lockers, courier (standard and oversized parcels) and — for large quantities — pallet shipping (individually quoted).
  3. Delivery is free of charge if the conditions shown in the order summary are met (e.g. orders from PLN 200); otherwise the cost is shown before order confirmation.
  4. Lead times are estimated and cover production only; the delivery time depends on the carrier. The Seller is not liable for carrier delays or delays caused by the Customer (missing files, address data, failure to collect).
  5. After dispatch the Customer receives an e-mail notification (including a tracking number, if available).
  6. International shipping: available upon individual inquiry — shipping cost and conditions outside Poland are agreed individually with the customer before the order is placed. For a quote, please contact us at info@digitaltrinity.pl.

§7. Right of withdrawal

  1. Every product in the Store is made to individual order — it does not exist before the order is placed — according to the Customer’s specification (product choice, parameters, materials and print files).
  2. Pursuant to Art. 38(1)(3) of the Polish Consumer Rights Act, the right to withdraw from a distance contract does not apply to contracts for the supply of goods made to the consumer’s specifications or clearly personalised.
  3. This paragraph constitutes the information referred to in Art. 12(1)(10) of the Polish Consumer Rights Act; reading it is a condition of concluding the contract.
  4. This section does not affect the Customer’s rights in case of non-conformity of the goods with the contract (§8).

§8. Complaints (non-conformity with the contract)

  1. The Seller is liable for non-conformity of the goods (printing service) with the contract under the Polish Consumer Rights Act (consumers) and the Civil Code warranty rules (B2B Customers).
  2. A complaint may be filed by e-mail to info@digitaltrinity.pl (preferably with the order number and photos documenting the defect) or in writing to the Seller’s address.
  3. The Seller handles the complaint within 14 days of receipt and replies to the Customer’s e-mail address.
  4. If the complaint is upheld (production inconsistent with the specification / production defect / damage in transit caused by the Seller’s packaging), the Seller — at the Customer’s choice — will remanufacture (correct printing), repair or reduce the price; in statutory cases the Customer may withdraw from the contract (refund to the original payment method, including basic delivery costs).
  5. Consumer: if the Seller fails to respond within 14 days of receiving the complaint, it is deemed accepted (Art. 7a of the Polish Consumer Rights Act).
  6. B2B: liability under the general warranty rules of the Civil Code (incl. notification periods).
  7. Consumers may use out-of-court complaint and redress mechanisms (e.g. municipal/powiat consumer ombudsman, Inspection of Commercial Quality Assurance amicable proceedings). The right to pursue judicial remedies remains unaffected.

§9. Personal data

  1. The administrator of the Customers’ personal data is the Seller.
  2. Data is processed to fulfil orders, issue accounting documents, communicate and defend claims, and — subject to consent — for marketing purposes.
  3. Details: Privacy Policy.

§10. Services by electronic means

  1. The Store enables: browsing the offer, product configuration, placing orders, uploading order files, receiving invoices and e-mail information.
  2. Technical requirements: a device with Internet access, an up-to-date browser (JS, cookies), an active e-mail account.
  3. The contract for services by electronic means is concluded for the period of use of the Store; the Customer may stop using it at any time.
  4. Reports concerning the Store’s operation: info@digitaltrinity.pl. The Customer may report unlawful content or breach of the contract; the Seller responds within a reasonable time.
  5. The Seller may temporarily suspend the Store (maintenance, failure) — this affects only the availability of online ordering.

§11. Final provisions

  1. The contract is concluded in Polish / German / English (depending on the Store version); the Polish version prevails in case of discrepancies between language versions.
  2. Matters not regulated herein are governed by Polish law: the Civil Code, the Polish Consumer Rights Act, the Act on Providing Services by Electronic Means.
  3. Consumer disputes are resolved by the competent court under general rules; B2B disputes — by the court competent for the Seller’s seat.
  4. The Seller may amend the Terms and Conditions (e.g. due to changes in law or the offer); orders placed before the change are fulfilled under the previous terms. Amendments take effect 7 days after publication in the Store.
  5. The Privacy Policy (personal data, cookies) is an integral part of the Terms and Conditions.
  6. Governing law and disputes: these terms are governed by Polish law. The courts with jurisdiction at the seller’s registered seat (Szczecin, Poland) shall have jurisdiction over any disputes with business customers. Consumers retain the right to bring proceedings before the courts of their domicile or habitual residence in accordance with applicable EU or national law; this right cannot be contractually excluded. Where the consumer is habitually resident in another EU member state, the mandatory consumer-protection provisions of that state’s law remain applicable in the consumer’s favour, including the mandatory provisions of German consumer law for consumers habitually resident in Germany (Art. 6(2) Rome I Regulation).
  7. Consumer arbitration (§ 36 VSBG): we are neither legally obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). This does not affect any consumer’s right to pursue claims through the ordinary courts.
